These Terms and Conditions (“Terms”) govern your access to and use of the PIXEL ONLINE eSIM services (the “Services”) provided by PIXEL ONLINE. ABN 34 297 542 192 (“PIXEL ONLINE”, “we”, “us”, or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not access or use our Services.
PIXEL ONLINE offers a platform for purchasing and managing electronic SIM cards (eSIM) for mobile devices as a reseller of prepaid eSIMs. Our Services include the sale of eSIM profiles and associated services, such as plan management and customer support, provided by third-party carriers and service providers.
Eligibility and Registration
To use our Services, you must be at least 18 years old and able to form legally binding contracts under applicable law. You may be required to register for an account to access certain features of our Services. You agree to provide accurate and complete information during registration and keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device.
When you make a purchase through our Services, you agree to provide valid and current payment information. You represent and warrant that you have the legal right to use the payment method(s) provided. We reserve the right to refuse, cancel or modify your order for any reason, including but not limited to product or service availability, errors in the description or price, or other reasons.
PIXEL ONLINE eSIM profiles are compatible with specific devices and carriers. It is your responsibility to ensure that your device is compatible with the eSIM profile and associated services before purchasing. We are not responsible for any incompatibility issues arising after the purchase of an eSIM profile.
All sales of eSIM profiles are final and non-refundable. In the event that a purchased eSIM profile is not compatible with your device or carrier, you may contact our customer support team for assistance. However, we do not guarantee that we will be able to provide a solution or a refund in such cases.
Limitation of Liability
To the fullest extent permitted by law, PIXEL ONLINE and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, resulting from your access to or use of or inability to access or use the Services, any conduct or content of any third party on the Services, any content obtained from the Services, or unauthorized access, use or alteration of your transmissions or content.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within Australia for the purpose of litigating all disputes arising out of or relating to these Terms or your use of the Services.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.
All intellectual property rights in the Services, including but not limited to copyrights, trademarks, and patents, are owned by PIXEL ONLINE or its licensors. You may not use any of our intellectual property rights without our prior written consent.

We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including, but not limited to, your breach of these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services. Any provisions of these Terms that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
These Terms and any policies or operating rules posted by us on our website or in respect to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
You may not assign, transfer or sublicense these Terms without our prior written consent. We may assign, transfer or sublicense these Terms without restriction.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
